Former Group Managing Director of the Nigerian National Petroleum Corporation (NNPC), Engr. Andrew Yakubu, on Tuesday withdrew the N1bn fundamental rights enforcement suit he filed against the Economic and Financial Crimes Commission (EFCC) over alleged violation of his fundamental rights.
Following the request by Yakubu to discontinue the case, the Federal High Court in Abuja threw out the case brought before Justice Ahmed Mohammed.
The embattled former NNPC boss had the anti-graft commission and the Attorney General of the Federation (AGF) over his detention in connection with the $9.8 million recovered from his Sabon Tasha home.
Yakubu’s lawyer, Adeola Adedipe, told the court on Tuesday that following intervening circumstances since the case was filed, his client resolved to discontinue with the case.
According to the Adedipe, “With a view to securing an order of striking out, we have filed a motion this morning, seeking the court’s leave to discontinue the case. We have served on parties.”
Counsels to both the EFCC and the AGF, Mrs. Rita Ogar and T. D. Agbe, confirmed being served with Yakubu’s motion, and did not oppose it.
Justice Mohammed struck out the case in view of the non-opposition by the respondents.
