The Court of Appeal sitting in Abuja on Monday, August 26, 2024, set aside the judgment of the Federal High Court in Abuja, which ordered the Peoples Democratic Party (PDP) to allow the participation of 381 ad-hoc delegates in the February 22, 2024, primary election that produced Asue Ighodalo as the Governorship candidate of the Party.

The PDP primary election produced Asue Ighodalo as the party’s candidate for the September 21, 2024, governorship election in Edo State.

A three-member panel of the Appeal Court in setting aside the decision of Justice Inyang Edem Ekwo which was delivered on July 4, 2024, held that the lower court lacked the jurisdiction to entertain the suit of the aggrieved delegates in the first place.

The appellate Court also held that those who instituted the suit lacked the necessary legal standing to do so and declared that the Federal High Court cannot interfere with how the PDP selected its candidate for the September 21, Governorship election in Edo State.
