Quash My Suspension As APC Chair – Oshiomhole Tells Appeal Court

BY EDMOND ODOK, ABUJA – The National Chairman of the All Progressive Congress (APC), Comrade Adams Oshiomhole, has approached the Appeal Court to reverse his suspension by the Federal Capital Territory (FCT) High Court sitting in Jabi, Abuja

In an appeal notice filed on Wednesday, March 4, 2020, Comrade Oshiomhole raised four grounds on which he is challenging the ruling delivered by Justice Danlami Senchi.

Justice Senchi had, in an interlocutory ruling earlier on Wednesday, ordered among others, that Comrade Oshiomhole should desist from parading himself as the APC National Chairman.

But in his application before the Court of Appeal in Abuja, Comrade Oshiomhole said the judge erred in law and arrived at a wrong conclusion, adding that it was a miscarriage of justice for the court to place him on suspension at an interlocutory stage of a suit instituted against his person by some aggrieved party members.

The former Edo State governor also argued the High Court further erred in law when it decided that he, in the performance of his duties as APC National Chairman, would interface in the court action filed against him by the aggrieved members.

He argued that the issue of performing his duties as APC National Chairman is a matter which arose from substantive issues for determination and claims, insisting that it ought not to have been determined at the interlocutory stage of the main matter.

Comrade Oshiomhole further claimed that Justice Senchi erred in law and arrived at a wrong conclusion which occasioned a miscarriage when after ordering the filing of pleadings and immediately set down motion for interlocutory injunction for hearing in the absence of pleadings.

The one time Nigeria Labour Congress (NLC) President further faulted the Justice Senchi ordered suspension on the grounds that as the trial judge, he determined the motion for interlocutory injunction without recourse to triable issues which ought to have been discerned from pleadings.

Among respondents in the appeal by the embattled APC National Chairman are: the party’s National Vice Chairman, North East, Comrade Mustapha Saliu; Edo State APC Chairman, Honourable Anselm Ojezua; Alhaji Sani Gomna; and Mr Oshawo Stephen.

Others include: Honourable Fani Wabulari; Evangelist Princewill Ejogharado; the Inspector General of Police; and the Department of State Security (DSS).

In a related development, a Federal High Court sitting in Kano on Thursday set aside the ruling of FCT High Court suspending the APC National Chairman, Comrade Oshiomhole.

According to Channelstv.com, Justice Lewis Allagoa, in setting aside the ruling, thereafter ordered the police and Department of State Service (DSS) to provide adequate security for Oshiomhole to resume in his office.
