The Supreme Court will by 2pm on Tuesday, May 9, 2023 deliver judgement on what is seen as a ‘make or mar’ decision in the July 16, 2022 Governorship election in Osun State.

The apex Court after taking arguments from parties involved in the case on Monday, May 8, 2023, fixed the date for the judgment delivery.

At the election petition is between Governor Ademola Adeleke, who is on the platform of the Peoples Democratic Party (PDP) and former Governor Adegboyega Oyetola of the All Progressives Congress (APC).

Former Governor Oyetola is the appellant in the matter before the Supreme Court having lost at the Court of Appeal while Governor Adeleke is the main respondent having won at the case at the Court of Appeal.

At the proceedings, Prince Lateef Fagbemi SAN argued for the APC.

The Court of Appeal in Abuja had on Friday, March 24, 2023, vacated the Governorship Tribunal judgment that nullified the election of Senator Ademola Adeleke governor of Osun State.

The Court of Appeal in a unanimous decision of a three-member panel delivered by Justice Mohammed Lawal, held that the appeal filed by Senator Adeleke challenging his sack by the Osun State Governorship Election Petition Tribunal was meritorious.

The appellate court apart from setting aside the judgment of the tribunal, also awarded N500, 000 cost against the All Progressive Congress (APC), and its candidate, former Governor Oyetola.
