The Court of Appeal sitting in Lagos State on Tuesday, November 28, 2023, affirmed the election of Siminalayi Fubara as the governor of Rivers State.
The appellate court also dismissed the petition filed by the governorship candidate of the All Progressives Congress (APC) in Rivers State, Chief Patrick Tonye-Cole against Governor Fubara of the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC).
Tonye-Cole, the APC candidate had requested that the court to order INEC to declare him as the rightful winner of the March governorship election in Rivers State.
The APC governorship candidate petition against Fubara’s election was also dismissed by the Rivers State Governorship Election Petition Tribunal in October 2023.
But, dissatisfied with the tribunal’s judgment, Tonye-Cole approached the appellate court for a review of the tribunal’s decision which the Court of Appeal upheld and affirmed Fubara’s victory.
