The Court of Appeal sitting in Lagos on Friday, November 3, 2023 upturned the verdict of the National Assembly Election Petitions Tribunal in Umuahia which dismissed the election of the member representing Isikwuato Umunneochi Federal Constituency of Abia State, Hon Amobi Ogah.
The Election Petition Tribunal had in September nullified Hon Ogah’s election and declared the candidate of the All Progressives Congress (APC), and current Minister of State for Labour, Nkiruka Onyejeocha as the winner of the election over alleged non-compliance with provisions of the Electoral Act.
Ogah dissatisfied with the decision of the Tribunal appealed the judgement and headed to the Court of Appeal which is the final stage in election matters with respect to the legislative election.
He called for calm following agitation by his supporters and other members of his constituency and urged them to be law abiding with the firm believe that the appellate Court would take a critical look at the case based on its merit.
The Court of Appeal in its decision, held that the appeal filed by the Labour Party candidate was meritorious and allowed same, thereby set aside the ruling of the Election Petition Tribunal.
