A Federal High Court sitting in Abuja, on Monday, September, 29, 2025 declared the plan to establish a ‘Shadow Government’ by a former presidential candidate, Professor Pat Utomi as illegal, unlawful and unconstitutional.
The court presided over by Justice James Omotosho also issued an order restraining Utomi and his associates from proceeding with their plan to establish a shadow government/cabinet in the country.
The decision of the court followed a suit filed by the Department of State Services (DSS), against the decision by Prof Utomi to establish a ‘Shadow Government’.
Justice Omotosho held that the concept of shadow government or cabinet was unconstitutional and an alien concept to the nation’s presidential system of government.
The court further declared that Utomi and his associates cannot hide under the rights of association and to criticise the government to engage in unlawful activities.
While commending the DSS for filing the suit, Justice Omotosho that it was within the right of the secret police to take steps to prevent acts capable of threatening the nation’s internal security.
