Supreme Court Dismisses Anyanwu’s Bid To Stay Judgment Sacking Him As PDP Scribe
The Supreme Court on Monday, March 10, 2025, dismissed the request by Senator Samuel Anyanwu seeking for stay of execution of the judgment of the Court of Appeal that removed him as National Secretary of the Peoples Democratic Party (PDP).
The apex court threw out the request when in what appeared a dramatic turn of events, Anyanwu through his legal counsel, Kingsley Njemanze, SAN, applied for withdrawal of the request indicating that Anyanwu might have backed down as he prayed the apex court to allow him withdraw the bid to stop the execution of the judgments against.
However, a panel of five justices led by Justice Musa Awani Aba-Aji dismissed the request.
A Federal High Court and the Court of Appeal sitting in Enugu had in their respective judgments sacked Samuel Anyanwu as he National Secretary of the PDP.
The Court of Appeal sitting in Enugu had last December upheld a Federal High Court decision that sacked Anyanwu as the National Secretary of the PDP.
The appellate court subsequently upheld Chief Sunday Udeh Okoye as the substantive National Secretary of the PDP.
The Court of Appeal in its lead judgment delivered by Justice Ridwan Abdullahi, held that Anyanwu‘s appeal was incompetent and lacking in merit.
The Appeal Court also held that Anyanwu violated the PDP constitution by laying claim to the position of National Secretary of the Party having contested and emerged as the party’s candidate in the 2024 governorship election in Imo State.
But, dissatisfied with the judgement, Anyanwu in February 2025, approached the Supreme Court to set aside the judgment of the two lower courts, and to recognize him as the National Secretary of the PDP.
Anyanwu also filed a motion for accelerated hearing and an abridgment of time on grounds of the crucial role of the office of National Secretary.
