Supreme Court Reserves Judgement In Atiku, Obi vs Tinubu Case, Strikes Out APM’s Appeal
The Supreme Court on Monday, October 23, 2023 reserved judgment in the appeal filed the Peoples Democratic Party’s (PDP) Presidential Candidate, Atiku Abubakar and that of the Labour Party (LP), Mr. Peter Obi, challenging the victory of President Bola Tinubu in the February 25 election.
The two presidential candidates and their parties appealed the judgment of the Presidential Election Petitions Court which affirmed Tinubu’s victory.
The seven-man panel of Justices led by Justice John Inyang Okoro, announced that the judgment date would be communicated to the parties.
In a related development, the apex Court, dismissed the appeal by the Allied People’s Movement (APM) over what it called lack of prayers for determination.
The Supreme Court also took arguments from lawyers to parties on the motion filed by Atiku to supply fresh evidence over alleged forged documents by President Tinubu for which the lead Counsel to Atiku, Mr Chris Uche, SAN, prayed the Court to grant the motion and allow the appeal sought by disqualifying Tinubu.
But counsel to the Respondents — Mr Abubakar Mahmoud for the Independent National Electoral Commission (INEC), Chief Wole Olanipekun, SAN, for President Tinubu, and Mr Akin Olujinmi SAN, for the All Progressives Congress (APC) unanimously asked the court to dismiss both the motion and appeal for lacking in merit.
