Appeal Court Sets Aside High Court Ruling Against Ize-Iyamu, Audu

BY SEGUN ADEBAYO, ABUJA – The governorship candidate of the All Progressives Congress (APC) in Edo State in the September 19, 2020 election, Pastor Osagie Ize-Iyamu, and his running mate, Alhaji Gani Audu, on Monday got reprieve as the Court of Appeal sitting in Benin, the Edo State capital ruled in their favour.

A three-man panel of the Court of Appeal set aside the judgment of the Edo High Court, Benin, which disqualified the duo of Ize-Iyamu and Audu from participating in the crucial election.

The panel members namely, Justices O.F. Omoleye, B.A. Georgewill and O.E. Oho in a unanimous ruling, declared that the case was statute barred given the fact that it was filed outside the 14-day constitutional threshold.

The Justices accordingly, upheld the appeal of Ize-Iyamu and Audu by setting aside the judgment of the Edo State High Court.

The Appeal Court further ruled that there was no evidence of credentials’ forgery on the part of Audu.
