Court Dismisses DSS’ Application For Extension Of Emefiele’s Detention

A High Court of the Federal Capital Territory (FCT), on Wednesday dismissed an application filed by the Department of State Services (DSS), seeking for an order to extend the detention of the suspended Central Bank of Nigeria (CBN), Governor, Mr. Godwin Emefiele.

It was gathered that the request was discreetly filed by the Secret Police legal team on Wednesday based on an alleged new evidence the Service obtained.

However, the trial judge, Justice Hamza Muazu dismissed the application saying that it was an abuse of court process and the lack of jurisdiction.

According to Channels Television, the DSS’ request for a fresh order followed the re-arrest of Emefiele by the Service on the premises of the Federal High Court, Lagos which granted the embattled Emefiele bail in the sum of N20 million and ordered that he should be remanded in a Correctional Centre pending when he would fulfil his bail conditions.

Counsel to the DSS, Victor Ejelonu, chose to withdraw the matter after the judge raised questions over issue of jurisdiction, given the exclusive rights of the Magistrate Court to grant detention orders under sections 293 and 296 of the Administration of Criminal Justice Act.
