Court Adjourns Hearing On El-Rufai’s Fresh Bail Application To May 13

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) on Tuesday, May 5, 2026, vehemently opposed a fresh bail application filed by former Governor of Kaduna State, Mallam Nasir El-Rufai, in the ongoing case before a High Court of Kaduna State.

El-Rufai through his counsel, Mr Ubong Akpang told the court at the resumption of proceedings on Tuesday, of a pending application, which he stressed has to do with the defendant’s fundamental right to liberty.

Akpang said that all requisite processes had been duly filed and served, and indicated readiness to proceed.

However, counsel to the ICPC, Mr. Ibrahim Mukhtar, told the court that the prosecution had just been served with the defendant’s further affidavit in support of the application and therefore requested for additional time to review the new filings.

Accordingly, the trial judge, Justice D.H. Khobo, adjourned the case to May 13, 2026, for the hearing of the bail application.

At the last sitting of the court, the presiding judge refused to grant El-Rufai bail, citing his failure to file a further affidavit to address the new issues raised in the ICPC’s counter-affidavit. The counsel to ICPC further argued that the defendant posed a flight risk due to his influence and resources, and cited possible obstruction of lawful arrest at the Nnamdi Azikiwe International Airport, Abuja.

The prosecution also alleged that El-Rufai refused to surrender his travel documents and electronic devices, adding that he has the potential to interfere with witnesses and evidence.

Ruling on the matter, Justice Khobo held that bail remains a discretionary relief guided by the interests of justice and declared that El-Rufai’s status could undermine ongoing investigations, particularly as some suspects are still at large. Justice Khobo also declared that El-Rufai’s failure to controvert key allegations raised by the prosecution amounted to an admission, and dismissed health-related claims as unsubstantiated.

Accordingly, the court turned down the bail and ordered that El-Rufai should remain in ICPC custody pending trial.

Despite the ruling, El-Rufai through his counsel still proceeded to file a fresh application for bail, which the ICPC opposed.
