Stay Married – Bauchi Sharia Court Tells Couple
Okays amicable crisis resolution
BY ADEYEMI AKANJI, BAUCHI – A Bauchi Upper Sharia Court is persuaded that allegations of physical and emotional abuse should not end the love relationship between a housewife, Aishatu Adamu Sulaiman and her husband, Umar Audu Mai Auduga.
Consequently, the court has asked that the couple to warmly resolve their differences and stay married as desired by their families.
In declining the plaintiff, Aishatu’s request to be free from her marriage, Presiding Judge, Malam Bello Mohammed Sambo said the Court stands by its earlier directive urging guardians of both parties to discuss and come up with harmonious resolution of the marital crisis.
He said the two sides were mandated to engage and decide if the union should continue or be terminated in line with Islamic injunctions on reconciliation between parties, especially couples.
The judge therefore said based on resolutions by both guardians suggesting the couple should forgive each other and remain together, the embattled wife should return to her matrimonial home and make peace with her husband.
However, reacting to the Court’s ruling, counsel to the plaintiff, Barrister Nasiru Balan Malam told Journalists that the divorce request came up because as his client could no longer endure the ill-treatment by her husband.
Expressing dissatisfaction with the ruling, he vowed to go for appeal in a higher Sharia court, claiming that Aishatu’s husband often instructed the children to abuse her amid other physical violations.
Also speaking at the court premises, lawyer to the husband, Zakariya Aliyu Libata hailed the judgment, insisting that his client would triumph everywhere should the plaintiff appealed against the ruling.
He said Mai Auduga has so far won the case in three Sharia courts within the state, claiming that the twosome are still very much in love with each other.
Libata alleged the mother-in-law is instigating her daughter to seek divorce because the husband has refused to allow her control the marriage and home from outside.
Aishatu had approached the Upper Sharia Court 4 Bauchi, requesting that her troubled marriage be dissolved as she was no longer comfortable in the union due maltreatment and endless humiliation that have now become permanent features in her home.
